Privacy Policy

Alianza Hispanoamericana NFP, Inc.

Alianza Hispanoamericana NFP, Inc. (“Alianza,” “we,” “us,” or “our”) recognizes the importance of privacy and is committed to handling personal information responsibly, transparently, and with appropriate care. This Privacy Policy describes our practices concerning information that may be collected when individuals visit our website, communicate with our organization, request information or assistance, participate in our programs or services, attend appointments or events, submit forms, communicate with our personnel, or otherwise interact with Alianza.

Our work may require individuals to provide information so that we can understand their requests, communicate with them, schedule or administer services, provide information, maintain organizational records, and perform the administrative functions necessary to operate a nonprofit organization. We recognize that individuals who interact with community-serving organizations may reasonably expect information concerning them to be handled with care.

This Privacy Policy is intended to explain, in a comprehensive manner, the categories of information that may be collected, the circumstances in which information may be collected, the purposes for which information may be used, the circumstances in which information may be disclosed, the measures we take to safeguard information, the choices available to individuals, and our practices concerning telephone and SMS/text-message communications.

This Privacy Policy applies to information handled by Alianza in connection with the activities described herein. Additional notices, disclosures, agreements, consent forms, program requirements, or legal requirements may apply in particular circumstances. Where a more specific notice or legally required disclosure applies to a particular activity, that notice may supplement this Privacy Policy.

1. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy applies to personal information that Alianza may collect through our website, online forms, telephone communications, email communications, SMS/text communications, in-person interactions, appointments, requests for information or assistance, participation in programs and services, and other interactions with our organization.

The nature of the information collected depends upon the individual's relationship and interaction with Alianza. Not every category of information described in this Privacy Policy is collected from every individual, and the inclusion of a category does not necessarily mean that Alianza collects that category in every circumstance.

This Privacy Policy is intended to provide a general description of our privacy practices. It does not create contractual rights beyond those provided under applicable law, nor should it be interpreted as expanding the application of a particular law where that law would not otherwise apply.

2. INFORMATION YOU PROVIDE TO US

Alianza may collect information that individuals voluntarily provide directly to our organization. This may occur when an individual contacts us, submits a website form, calls our office, sends an email, communicates with a staff member, requests an appointment, requests information or services, participates in a program, provides documents, or otherwise interacts with our organization.

Depending upon the circumstances, information provided to Alianza may include a person's name, telephone number, mobile telephone number, email address, mailing address, preferred language, appointment information, communications preferences, information contained in correspondence, documents voluntarily submitted to our organization, and other information reasonably related to the individual's request or interaction with Alianza.

We may also receive information that an individual voluntarily provides during subsequent communications with our personnel. The amount and type of information required may vary according to the program, service, request, or activity involved.

We endeavor to request information reasonably related to legitimate organizational purposes and the services or assistance being requested.

3. INFORMATION COLLECTED THROUGH OUR WEBSITE

When an individual visits our website, certain technical information may be transmitted automatically by the individual's browser, device, internet service provider, website platform, or related technologies.

Depending upon the configuration of our website and the services used to operate it, this information may include an Internet Protocol address, browser type, device type, operating system, referring website, pages viewed, dates and times of visits, approximate technical location information, and other information ordinarily transmitted in connection with accessing a website.

This information may be used to operate and maintain our website, identify technical problems, protect the security of our systems, understand general website usage, improve functionality, and support our online services.

Our website may rely upon third-party technology providers for hosting, security, communications, analytics, forms, or other functionality. Those providers may process information as necessary to provide their respective services, subject to their agreements and applicable requirements.

4. INFORMATION PROVIDED THROUGH FORMS

Alianza may make forms available through its website or through other electronic or physical means.

Information submitted through a form may be used to respond to the purpose for which the form was submitted, contact the individual, schedule an appointment, respond to an inquiry, provide requested information, determine how our organization may assist the individual, maintain appropriate records, or perform related administrative functions.

Submission of a telephone number through a general form does not, by itself, necessarily constitute consent to receive SMS marketing or other communications for which separate consent is required.

Where Alianza requests consent for SMS communications, the applicable consent language should be presented to the individual separately and in accordance with our SMS practices described below.

5. HOW WE USE PERSONAL INFORMATION

Alianza may use personal information for legitimate nonprofit, administrative, operational, service-related, communication, security, and legal purposes.

These purposes may include responding to inquiries; communicating with individuals; providing requested information; administering programs and services; scheduling, confirming, changing, or reminding individuals about appointments; requesting information or documents; providing updates concerning an individual's interaction with Alianza; responding to questions; maintaining appropriate organizational records; coordinating services; and performing related administrative activities.

Information may also be used to maintain and improve organizational operations, administer our website and communications systems, protect against misuse or unauthorized activity, comply with applicable legal obligations, maintain records, investigate technical or security issues, and protect the rights and safety of Alianza and others.

We endeavor to use information in a manner reasonably consistent with the context in which it was provided and the purposes disclosed to the individual.

6. COMMUNICATIONS WITH ALIANZA

Individuals may communicate with Alianza through various methods, which may include telephone, email, website forms, written correspondence, in-person communications, and, where appropriate consent has been provided, SMS/text messaging.

When an individual communicates with us, we may maintain information concerning that communication as reasonably necessary to respond to the individual, provide services, maintain appropriate records, document requests, improve our operations, or comply with applicable requirements.

The availability of a particular communication method may vary according to the nature of the request, program, or service.

7. SMS AND TEXT-MESSAGE COMMUNICATIONS

Alianza may offer SMS/text messaging as a convenient method of communicating with individuals who have provided an appropriate mobile telephone number and have consented to receive such communications.

SMS messages may relate to appointments, appointment confirmations, appointment reminders, scheduling or rescheduling, requests for missing information or documentation, case-related notifications, responses to inquiries, information requested by the recipient, service-related communications, and other conversational communications associated with the individual's interaction with Alianza.

Message frequency varies. Message and data rates may apply.

Recipients may request assistance by replying HELP. Recipients may discontinue SMS communications by replying STOP.

Consent to receive SMS/text messages is voluntary and is not required as a condition of receiving services from Alianza Hispanoamericana NFP, Inc.

Alianza may maintain records reasonably necessary to document an individual's SMS consent, communication preferences, opt-in status, opt-out status, or related communications.

8. SMS CONSENT, MOBILE NUMBERS, AND INFORMATION SHARING

Alianza considers SMS consent information to have been provided for the specific purpose of managing communications between the individual and our organization.

SMS opt-in consent is not shared with third parties or affiliates.

Mobile telephone numbers and SMS opt-in information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Alianza may use vendors and technology providers that perform operational services necessary to facilitate communications on our behalf. For example, telecommunications or technology providers may necessarily process telephone numbers or message information to transmit and deliver communications. Such operational processing does not authorize those providers to use SMS opt-in consent for their own marketing or promotional purposes.

An individual's decision not to consent to SMS communications, or subsequently to withdraw SMS consent, does not prevent the individual from requesting services from Alianza through other available methods.

9. WITHDRAWAL OF SMS CONSENT

An individual who no longer wishes to receive SMS communications may reply STOP to an applicable message.

Alianza will endeavor to process valid opt-out requests in accordance with applicable requirements. After an opt-out request has been processed, the individual will no longer receive the applicable SMS communications unless the individual subsequently provides appropriate consent to receive messages again.

Where permitted by applicable requirements, a limited message may be sent to confirm that an opt-out request has been processed.

Individuals may also contact Alianza directly concerning their communication preferences. Withdrawal of SMS consent does not withdraw consent for unrelated communications where another lawful basis or separate permission exists.

10. DISCLOSURE OF PERSONAL INFORMATION

Alianza does not sell or rent personal information for commercial marketing purposes.

Personal information may be disclosed where reasonably necessary to perform services requested by an individual, administer organizational operations, work with service providers performing functions on behalf of Alianza, maintain or protect our technology systems, comply with applicable legal obligations, or otherwise carry out legitimate organizational activities.

Information may also be disclosed when an individual directs or authorizes us to make a disclosure.

Where appropriate, we endeavor to limit disclosure to information reasonably necessary for the applicable purpose.

Nothing in this section changes our commitment concerning SMS consent: SMS opt-in consent is not shared with third parties or affiliates.

11. SERVICE PROVIDERS AND ORGANIZATIONAL OPERATIONS

Like many organizations, Alianza may rely upon third-party service providers to perform certain operational functions.

Depending upon our operations, such providers may support website hosting, telecommunications, information technology, communications, scheduling, data storage, security, document management, professional services, or similar organizational functions.

A service provider may receive or process information where reasonably necessary to perform services on behalf of Alianza. We expect service providers handling information on our behalf to do so consistently with applicable contractual obligations and legal requirements.

The use of an operational service provider should not be interpreted as permission for that provider to independently market to individuals using SMS consent obtained by Alianza.

12. NO SALE OF SMS CONSENT

Alianza does not sell SMS opt-in consent.

Alianza does not rent SMS opt-in consent.

Alianza does not provide SMS opt-in consent to third parties or affiliates for their independent marketing or promotional activities.

These restrictions apply regardless of other provisions of this Privacy Policy concerning ordinary operational service providers.

13. DATA SECURITY

Alianza recognizes the importance of maintaining appropriate safeguards for personal information.

We endeavor to use reasonable administrative, technical, organizational, and physical measures designed to protect information from unauthorized access, acquisition, loss, misuse, alteration, destruction, or disclosure.

Security measures may vary depending upon the nature and sensitivity of the information, the systems through which it is processed, technological developments, organizational requirements, and applicable legal obligations.

Access to personal information should be limited to individuals and service providers that have a legitimate organizational reason to access the information.

Despite reasonable safeguards, no website, electronic communication system, computer network, telephone network, database, or storage system can be guaranteed to be completely secure. Consequently, Alianza cannot guarantee absolute security.

14. DATA RETENTION

Alianza may retain personal information for as long as reasonably necessary to fulfill the purpose for which the information was collected, provide requested programs or services, maintain appropriate records, satisfy administrative requirements, comply with applicable legal obligations, resolve disputes, protect organizational rights, or fulfill other legitimate nonprofit purposes.

Retention periods may differ depending upon the category of information and the purpose for which the information is maintained.

When information is no longer reasonably necessary and no legal or legitimate organizational requirement justifies continued retention, information may be deleted, destroyed, anonymized, or otherwise disposed of in an appropriate manner.

15. COOKIES AND SIMILAR TECHNOLOGIES

Our website may use cookies or similar technologies provided by our website platform or related service providers.

Cookies are small data files or similar technologies that may help websites maintain functionality, remember certain preferences, protect security, understand website activity, or improve user experience.

The specific cookies and technologies used may change as our website and technology providers evolve.

Individuals may have the ability to manage certain cookie preferences through their browser or other available controls. Disabling certain technologies may affect the operation or functionality of portions of the website.

16. THIRD-PARTY LINKS AND SERVICES

Our website may contain links to websites, resources, platforms, or services operated by organizations other than Alianza.

The presence of a third-party link does not necessarily mean that Alianza owns, controls, endorses, or assumes responsibility for that third party's privacy practices.

Once an individual leaves our website, the collection and handling of information may be governed by the privacy policy and terms of the third-party service.

We encourage individuals to review the privacy practices of websites and services they choose to use.

17. INFORMATION RELATING TO MINORS

Alianza is a community-serving nonprofit organization, and some of our programs or activities may involve families or individuals of different ages.

Where information concerning a minor is collected, Alianza endeavors to handle such information consistently with applicable requirements and the nature of the program or service involved.

Where parental, guardian, representative, or other authorization is legally required, Alianza may take appropriate steps to obtain or document such authorization.

Our website is not designed for the purpose of commercially marketing products to children.

18. ILLINOIS PRIVACY AND DATA-SECURITY REQUIREMENTS

Because Alianza operates in Illinois, certain information-handling activities may be governed by Illinois law.

The Illinois Personal Information Protection Act, 815 ILCS 530, establishes requirements concerning certain personal information, including requirements relating to reasonable security measures and notification following certain breaches of personal information.

Where applicable to information maintained by Alianza, we endeavor to maintain reasonable security measures and to evaluate security incidents in accordance with applicable legal requirements.

The application of a particular statutory requirement depends upon the information and circumstances involved.

19. BIOMETRIC INFORMATION

Illinois law provides specific protections concerning certain biometric identifiers and biometric information under the Illinois Biometric Information Privacy Act, 740 ILCS 14.

This Privacy Policy does not represent that Alianza collects biometric identifiers or biometric information.

If Alianza were to engage in an activity subject to biometric privacy requirements, applicable notice, consent, disclosure, retention, destruction, and security obligations would need to be considered before implementing that activity.

20. FEDERAL TELEPHONE AND TEXT-MESSAGE REQUIREMENTS

Telephone calls and text messages may be subject to federal communications laws and regulations, including, where applicable, provisions of the Telephone Consumer Protection Act and rules administered by the Federal Communications Commission.

Alianza endeavors to conduct covered communications consistently with applicable consent and opt-out requirements.

An individual who has consented to receive SMS communications may withdraw consent through applicable methods, including replying STOP to covered messages.

Nothing in this Privacy Policy is intended to waive or restrict rights available to individuals under applicable communications laws.

21. EMAIL COMMUNICATIONS

Individuals who provide an email address may receive communications relating to their interaction with Alianza, including responses to inquiries, requested information, appointment-related communications, or other organizational communications.

Certain commercial electronic communications may be subject to requirements established under federal law, including the CAN-SPAM Act where applicable.

The legal requirements applicable to a particular email depend upon its nature, content, purpose, and surrounding circumstances.

22. LEGAL PROCESS AND GOVERNMENT REQUESTS

Alianza may preserve, use, or disclose information when reasonably believed to be necessary and legally permitted or required to respond to applicable law, regulation, subpoena, warrant, court order, governmental request, or other valid legal process.

We may also preserve or disclose information where reasonably necessary and legally permissible to protect the rights, property, security, or safety of Alianza, individuals interacting with our organization, personnel, service providers, or others.

The existence of this provision does not mean that information will automatically be disclosed whenever requested. The circumstances and applicable legal requirements should be evaluated as appropriate.

23. FRAUD, SECURITY, AND MISUSE

Alianza may use information as reasonably necessary to identify, investigate, prevent, or respond to suspected fraud, unauthorized access, misuse of our website or systems, security incidents, or activities that threaten the integrity of our operations.

Where appropriate, information may be preserved or provided to relevant service providers, professional advisers, insurers, governmental authorities, law enforcement, or other appropriate parties when legally permitted or required.

24. ORGANIZATIONAL CHANGES

If Alianza undergoes a reorganization, restructuring, combination, transfer of operations, or similar organizational change, information may be transferred or otherwise handled as reasonably necessary in connection with that change and subject to applicable law.

Any successor organization receiving personal information would be expected to handle such information in accordance with applicable requirements and any commitments that continue to apply.

25. PRIVACY RIGHTS AND REQUESTS

Individuals may contact Alianza with questions concerning personal information they have provided to us or concerning the privacy practices described in this Policy.

Depending upon applicable law and the circumstances, an individual may have rights relating to access, correction, deletion, or other treatment of certain information.

Such requests may be subject to identity verification, legal limitations, record-retention requirements, exceptions, and other applicable considerations.

SMS preferences may be changed independently by replying STOP to opt out of SMS communications.

26. DO NOT TRACK AND BROWSER CONTROLS

Web browsers and devices may provide privacy-related settings or signals.

The availability and operation of these mechanisms vary among browsers, devices, technologies, and website platforms. Unless otherwise required by applicable law, our website may not respond to every browser-based privacy signal in the same manner.

Individuals may use the controls provided by their browser or device to manage certain privacy and website settings.

27. INTERNATIONAL ACCESS

Our organization principally serves individuals in connection with its activities in the United States. Our website, however, may technically be accessible from locations outside the United States.

Individuals accessing the website from another jurisdiction should understand that information may be processed in the United States, subject to applicable requirements.

The accessibility of our website in another jurisdiction does not necessarily mean that Alianza directs its programs or services to that jurisdiction.

28. CHANGES TO OUR PRIVACY PRACTICES

Technology, organizational practices, legal requirements, and the services offered by Alianza may change over time.

Accordingly, Alianza reserves the ability to modify this Privacy Policy when appropriate.

When we make changes, we may update the “Last Updated” date appearing at the beginning of the Policy. Material changes may also be communicated through other reasonable methods where appropriate or legally required.

Continued availability of an older copy of this Policy should not be interpreted as a representation that the older version remains current.

29. INTERPRETATION OF THIS POLICY

Headings are provided for convenience and organization.

References to statutes, regulations, or legal requirements are intended to describe areas that may be relevant to our privacy practices and should not be interpreted as a representation that every provision of every referenced law applies to every activity of Alianza.

If a provision of this Privacy Policy conflicts with a requirement imposed by applicable law, the applicable legal requirement controls to the extent of the conflict.

Nothing in this Privacy Policy is intended to waive rights or obligations that cannot lawfully be waived.
