Please read these Terms carefully. By accessing, browsing, or using our website, you acknowledge that you have had an opportunity to review these Terms and agree to use our website in accordance with these Terms and all applicable laws and regulations.

Certain programs, services, forms, events, communications, or other activities offered by Alianza may be subject to additional notices, disclosures, agreements, eligibility requirements, consent forms, or terms. Where additional terms apply, those terms are intended to supplement these Terms.

If you do not agree with these Terms, you should discontinue use of the portions of the website governed by them.

1. ABOUT ALIANZA HISPANOAMERICANA NFP, INC.

Alianza Hispanoamericana NFP, Inc. is a nonprofit organization serving individuals, families, and communities through programs, services, education, outreach, assistance, and other community-oriented activities.

Alianza provides information and services through its personnel, programs, community activities, website, telephone communications, electronic communications, and other appropriate channels.

Information concerning particular programs and services may be available on our website or by contacting Alianza directly.

The availability, eligibility requirements, scope, duration, funding, staffing, and other characteristics of programs and services may change over time.

Nothing contained on this website should be interpreted as a guarantee that any particular program, service, benefit, representation, appointment, financial assistance, immigration benefit, government benefit, or other outcome will be available to a particular individual.

2. PURPOSE OF OUR WEBSITE

The Alianza website is maintained to provide information about our organization, mission, programs, services, resources, activities, contact information, and other matters that may be useful to the communities we serve.

The website may also provide methods through which individuals can contact our organization, submit inquiries, provide information, request appointments, learn about available programs, access external resources, or communicate with Alianza.

Information presented on the website is provided for general informational and organizational purposes. Although we endeavor to maintain useful and accurate information, website information may not always reflect the most recent developments.

Programs, requirements, procedures, government policies, laws, regulations, forms, fees, deadlines, processing times, and other matters may change without immediate corresponding changes to our website.

Individuals should contact Alianza directly when confirmation of current information is important.

3. ACCEPTABLE USE OF THE WEBSITE

You agree to use the Alianza website for lawful purposes and in a manner consistent with these Terms.

You may use publicly available portions of the website for personal, informational, educational, and other lawful purposes consistent with the purpose for which those materials are provided.

You may not knowingly use the website in a manner intended to interfere with its operation, compromise its security, gain unauthorized access to systems or information, impersonate another person, transmit malicious software, submit fraudulent information, engage in unlawful activity, or interfere with another person's legitimate use of the website.

You may not attempt to circumvent technological measures intended to protect our website, systems, information, or users.

Alianza reserves the right to take reasonable measures to protect the security, integrity, availability, and lawful operation of its website and information systems.

4. INFORMATION PROVIDED THROUGH THE WEBSITE

Alianza endeavors to provide accurate and useful information. Nevertheless, information available through the website is generally provided for informational purposes and may be modified, corrected, updated, supplemented, or removed.

Information contained on the website should not automatically be interpreted as individualized advice applicable to every person's circumstances.

A person's circumstances may differ significantly from those described in general educational materials.

Individuals should communicate directly with appropriate Alianza personnel regarding questions about services provided by Alianza and should seek appropriate professional assistance when a matter requires individualized professional advice.

5. IMMIGRATION AND LEGAL INFORMATION

Certain Alianza programs involve immigration-related information and services.

General immigration information presented on our website, social-media pages, educational materials, workshops, resources, or other public communications is intended primarily for educational and informational purposes.

Immigration laws, regulations, policies, procedures, filing requirements, fees, deadlines, forms, processing practices, and governmental interpretations can change.

General information appearing on a website should therefore not be relied upon as a substitute for an individualized review of a person's particular circumstances.

Viewing the website, reading educational materials, submitting a general website inquiry, or receiving general information does not by itself establish an attorney-client or representative-client relationship.

Where Alianza formally agrees to provide representation or individualized services, the scope and conditions of those services may be addressed through separate documentation or communications.

6. NO GUARANTEE OF RESULTS

Alianza cannot guarantee the outcome of an immigration matter, government application, administrative proceeding, request for benefits, application for assistance, referral, or other matter involving decisions by governmental agencies, courts, funding entities, service providers, or other independent organizations.

Government agencies and other organizations maintain their own procedures, eligibility requirements, processing times, policies, and decision-making authority.

Statements concerning potential outcomes, processing times, eligibility, availability, or other matters should therefore be understood in light of the particular circumstances and the authority of the organization ultimately responsible for making the applicable decision.

Past results do not guarantee future results.

7. PROGRAM ELIGIBILITY AND AVAILABILITY

Programs offered or administered by Alianza may have eligibility requirements established by law, grant requirements, funding sources, government programs, partner organizations, internal program requirements, geographic limitations, income guidelines, capacity limitations, or other applicable criteria.

Submission of information or an application does not necessarily guarantee acceptance, eligibility, funding, representation, an appointment, or participation.

Program availability may depend upon available resources, funding, staffing, demand, eligibility, deadlines, program capacity, and other circumstances.

Alianza reserves the right to modify, suspend, discontinue, expand, or otherwise change programs and services when appropriate and consistent with applicable obligations.

8. APPOINTMENTS

Alianza may permit individuals to request or schedule appointments through telephone communications, website forms, in-person communications, SMS communications, or other available methods.

Submitting an appointment request does not necessarily mean that an appointment has been confirmed unless confirmation is provided by Alianza.

Individuals are responsible for providing accurate contact information and, where appropriate, notifying Alianza when they cannot attend a scheduled appointment.

Appointment availability may change because of staffing, emergencies, office closures, program requirements, demand, or other circumstances.

Alianza may contact individuals concerning appointment reminders, confirmations, cancellations, rescheduling, missing information, or other matters associated with their appointment or requested services.

9. INFORMATION AND DOCUMENTS PROVIDED TO ALIANZA

Individuals are responsible for providing information that is accurate and complete to the best of their knowledge when requesting services or communicating with Alianza.

Alianza may rely upon information provided by individuals when evaluating requests, preparing documents, scheduling services, responding to inquiries, or performing other appropriate activities.

Providing false, misleading, incomplete, altered, or fraudulent information may prevent Alianza from appropriately evaluating or assisting with a matter and may have additional consequences depending upon the circumstances.

Individuals should notify appropriate Alianza personnel when they discover that information previously provided was inaccurate or incomplete.

10. ELECTRONIC COMMUNICATIONS

By communicating electronically with Alianza, you acknowledge that communications may occur through email, website forms, telephone systems, SMS/text messages, or other electronic technologies where appropriate.

Electronic communications involve inherent technological risks, including transmission errors, delays, service interruptions, misdirected communications, device access, and other circumstances outside Alianza's reasonable control.

Individuals are responsible for maintaining appropriate control over their own devices, email accounts, telephone numbers, passwords, and other communication methods.

Where a communication contains information that an individual considers particularly sensitive, the individual may contact Alianza regarding other available communication methods.

11. SMS/TEXT-MESSAGING PROGRAM

Alianza may offer SMS/text messaging to individuals who provide an appropriate mobile telephone number and consent to receive SMS communications.

SMS communications are intended to facilitate legitimate communications between Alianza and individuals who have chosen to communicate through text messaging.

Messages may include appointment reminders and confirmations, appointment scheduling or rescheduling information, case-related updates, requests for missing information or documentation, responses to inquiries, information requested by the recipient, follow-up communications, service-related notices, and other conversational communications associated with the recipient's interaction with Alianza.

Message frequency varies. Message and data rates may apply.

The frequency of messages received by an individual may depend upon that individual's appointments, inquiries, requested services, pending matters, communications with Alianza, and other circumstances.

Alianza does not guarantee that every communication concerning a person's interaction with the organization will be delivered through SMS.

12. SMS CONSENT

Alianza sends covered SMS communications to individuals who have provided the appropriate consent to receive such messages.

Consent may be obtained through an applicable website form, an affirmative selection associated with an SMS consent disclosure, or another consent process used by Alianza where appropriate.

Where consent is obtained through an online form, the applicable SMS disclosure is intended to inform the individual about the nature of the communications before the individual chooses whether to consent.

Consent to receive SMS/text messages is not required as a condition of receiving services from Alianza Hispanoamericana NFP, Inc.

Individuals who do not wish to receive SMS messages may communicate with Alianza through other available methods.

13. SMS OPT-OUT

Recipients may withdraw consent to receive applicable SMS communications.

To opt out, a recipient may reply STOP to an SMS message from Alianza.

Upon receipt and processing of an applicable opt-out request, Alianza will discontinue the SMS communications covered by that request in accordance with applicable requirements.

A limited confirmation message may be sent acknowledging that the opt-out request has been processed where permitted.

Individuals should understand that opting out of SMS communications does not terminate their relationship with Alianza, cancel an appointment, withdraw an application, terminate representation where representation separately exists, or prevent them from using other available communication methods.

14. SMS HELP AND SUPPORT

Recipients requiring assistance concerning Alianza SMS communications may reply HELP.

Recipients may also contact Alianza through the contact information provided at the end of these Terms.

Depending upon the circumstances, assistance may include information concerning the identity of the sender, communication preferences, opt-out procedures, or methods of contacting the organization.

15. SMS MESSAGE AND DATA RATES

Alianza does not generally charge recipients a separate fee merely for receiving ordinary Alianza SMS communications.

However, message and data rates may apply according to the recipient's wireless service plan and mobile carrier.

Charges imposed by a mobile carrier, telecommunications provider, device provider, or other third party are the responsibility of the recipient.

Individuals with questions about their wireless plan, text-message charges, data charges, or other carrier fees should contact their telecommunications provider.

16. SMS DELIVERY AND CARRIER AVAILABILITY

Delivery of SMS messages is subject to telecommunications networks, wireless carriers, devices, network availability, technical systems, and other circumstances that may be outside Alianza's control.

Alianza does not guarantee that every SMS message will be delivered, delivered immediately, or received in the order transmitted.

Carriers are not responsible for delayed or undelivered messages to the extent provided under applicable carrier practices.

An individual should not rely exclusively upon SMS for urgent communications or matters requiring immediate attention.

17. SMS PRIVACY

Information associated with SMS communications is handled in accordance with the Alianza Privacy Policy and applicable requirements.

SMS opt-in consent is not shared with third parties or affiliates.

Mobile information and SMS opt-in information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Alianza may use telecommunications, technology, and other operational service providers where reasonably necessary to facilitate communications on behalf of the organization.

Use of an operational provider does not authorize that provider to use Alianza's SMS consent records for its own independent marketing or promotional purposes.

For additional information regarding how Alianza handles personal information, please review our Privacy Policy.

18. TELEPHONE NUMBERS AND REASSIGNED NUMBERS

Individuals who provide a telephone or mobile number are responsible for providing a number through which they may appropriately be contacted.

If an individual changes, disconnects, transfers, or no longer controls a telephone number previously provided to Alianza, the individual is encouraged to notify us so that our records can be updated.

A recipient who receives a message intended for another person may contact Alianza or use an appropriate opt-out mechanism.

Alianza may take reasonable steps to correct or suppress telephone information when it becomes aware that information is outdated or incorrect.

19. THIRD-PARTY WEBSITES AND EXTERNAL RESOURCES

The Alianza website may contain links to government websites, community organizations, service providers, educational resources, partner organizations, and other third-party websites.

These links may be provided as a convenience or informational resource.

Alianza does not necessarily control third-party websites and is not responsible for their content, availability, security, accuracy, accessibility, privacy practices, or terms.

A link to another organization does not necessarily constitute an endorsement, sponsorship, partnership, legal relationship, or guarantee by Alianza unless expressly stated otherwise.

Individuals who visit third-party websites should review the terms and privacy policies applicable to those websites.

20. GOVERNMENT WEBSITES AND INFORMATION

Our website may provide links or references to government agencies or government resources.

Unless expressly stated otherwise, Alianza is an independent nonprofit organization and the existence of a link to a government website should not be interpreted as implying that Alianza owns or operates that government service.

Government forms, fees, filing requirements, policies, deadlines, processing times, and procedures may change.

Individuals should consult the appropriate government source or appropriate qualified assistance when current official information is required.

21. INTELLECTUAL PROPERTY

Unless otherwise indicated, content created and published by Alianza on its website, including original text, organizational materials, graphics, design elements, logos, names, photographs, educational materials, and other content, may be protected by copyright, trademark, or other applicable intellectual-property laws.

Individuals may view publicly available website materials for ordinary personal and informational purposes.

Except where permitted by applicable law or expressly authorized by Alianza, users should not reproduce, modify, republish, distribute, sell, commercially exploit, misrepresent, or remove ownership notices from protected Alianza materials.

Third-party names, logos, trademarks, materials, and content remain the property of their respective owners.

22. ALIANZA NAME AND LOGO

The Alianza Hispanoamericana NFP, Inc. name, organizational identity, logo, and related branding may not be used in a manner that falsely suggests authorization, sponsorship, endorsement, employment, representation, partnership, or affiliation.

Nothing contained on the website grants an implied license to use Alianza's name, logo, branding, or other protected identifiers for commercial or misleading purposes.

Requests concerning authorized use of Alianza materials may be directed to the organization.

23. USER SUBMISSIONS

Individuals may provide information to Alianza through forms, email, telephone communications, or other available methods.

By submitting information, an individual represents that, to the best of their knowledge, the information they provide is not intentionally fraudulent, unlawful, malicious, or submitted for the purpose of compromising Alianza's systems or operations.

Submission of information does not transfer ownership of an individual's personal information to Alianza. Personal information is handled in accordance with our Privacy Policy and applicable requirements.

24. WEBSITE SECURITY

Users may not knowingly attempt to interfere with the security or proper operation of the Alianza website.

Prohibited conduct includes knowingly introducing malicious code, attempting unauthorized access, probing systems for vulnerabilities without authorization, interfering with website availability, attempting to obtain information through unauthorized means, or using the website to engage in unlawful activity.

Alianza may take reasonable technical, administrative, or legal measures to protect its systems, information, personnel, and users.

25. AVAILABILITY OF THE WEBSITE

Alianza endeavors to maintain its website as a useful community resource. However, continuous or uninterrupted availability cannot be guaranteed.

The website may occasionally become unavailable because of maintenance, updates, technical problems, telecommunications failures, security measures, third-party service interruptions, circumstances beyond our control, or other reasons.

Alianza may modify, suspend, replace, restrict, or discontinue portions of the website when reasonably necessary.

26. PRIVACY

Use of the Alianza website is also subject to our Privacy Policy.

The Privacy Policy describes our practices concerning the collection, use, disclosure, security, retention, and handling of certain personal information and contains additional provisions specifically addressing mobile telephone information and SMS consent.

These Terms and the Privacy Policy should be read together.

If a specific consent notice or disclosure is presented when an individual submits information, that notice may provide additional information concerning the particular collection or use involved.

27. CHILDREN AND FAMILIES

Alianza serves communities and families, and certain programs may involve minors or information relating to minors.

Where parental, guardian, representative, or other authorization is required, Alianza may request appropriate consent or documentation.

The website is not intended to encourage children to independently provide sensitive personal information when parental, guardian, or other legally appropriate authorization is required.

The requirements applicable to a particular program or service may vary according to applicable law and the nature of the service.

28. ACCESSIBILITY AND LANGUAGE

Alianza serves a diverse community and may make information available in more than one language.

We endeavor to make information reasonably accessible to the communities we serve. However, translations may occasionally contain differences in wording or interpretation.

Individuals who have questions concerning the meaning of a particular provision, form, notice, or communication should contact Alianza for clarification.

Where a legally controlling document specifies which language version governs, that document's terms will apply.

29. DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, the publicly available website and general website materials are provided on an “as available” basis.

Alianza endeavors to maintain useful, accurate, and secure information but does not warrant that every portion of the website will at all times be uninterrupted, error-free, completely current, free of technical defects, or suitable for every user's particular circumstances.

Nothing in this section is intended to disclaim responsibilities that cannot lawfully be disclaimed.

30. LIMITATION REGARDING THIRD-PARTY SERVICES

Alianza is not responsible for the independent acts, omissions, systems, policies, availability, or decisions of unrelated third-party organizations merely because the website provides information about or links to them.

Government agencies, telecommunications providers, website platforms, external service organizations, and other third parties maintain their own systems and policies.

Any rights or remedies that cannot lawfully be limited by these Terms remain unaffected.

31. EMERGENCIES

The Alianza website, general email addresses, website forms, and ordinary SMS program are not intended to function as emergency-response services.

Individuals experiencing an emergency should use the appropriate emergency services available to them rather than relying upon a website form, email, voicemail, or SMS message to Alianza.

Alianza cannot guarantee immediate review or response to electronic communications.

32. COMPLIANCE WITH APPLICABLE LAW

Alianza endeavors to operate its website and communications practices consistently with applicable federal, Illinois, and local requirements.

Depending upon the activity involved, relevant laws and regulations may include requirements relating to privacy, data security, nonprofit operations, consumer communications, electronic communications, and telephone or SMS messaging.

Certain telephone and text-message activities may be governed by the federal Telephone Consumer Protection Act and regulations or orders administered by the Federal Communications Commission.

The inclusion of a reference to a particular law does not represent that every provision of that law applies to every activity undertaken by Alianza.

33. CHANGES TO THESE TERMS

Alianza may modify these Terms periodically to reflect changes in our website, programs, communications practices, technology, legal requirements, organizational operations, or other circumstances.

When these Terms are updated, the “Last Updated” date appearing at the beginning of the document may be revised.

Where additional notice is required by applicable law, Alianza will endeavor to provide such notice in the manner required.

Individuals are encouraged to review these Terms periodically.

34. SEVERABILITY

If a provision of these Terms is determined by a court or other authority with appropriate jurisdiction to be invalid, unlawful, or unenforceable, the remaining provisions should continue to operate to the extent permitted by applicable law.

An invalid or unenforceable provision should be interpreted or limited to the extent reasonably necessary to make it enforceable where permitted rather than invalidating the Terms as a whole.

35. NO WAIVER

A failure by Alianza to enforce a provision of these Terms in a particular circumstance does not necessarily constitute a permanent waiver of that provision or of Alianza's ability to enforce it in another appropriate circumstance.

Any waiver that is legally required to be in writing will be effective only when made in the legally required manner.

36. HEADINGS

Section titles and headings are provided for convenience and organization.

They do not independently expand, restrict, or modify the substantive provisions of these Terms.

37. GOVERNING LAW

To the extent permitted by applicable law, these Terms and matters concerning the use of the Alianza website will be interpreted under applicable laws of the United States and the

State of Illinois, without limiting rights or protections that cannot lawfully be waived.

Nothing in these Terms is intended to prevent an individual from exercising rights provided under applicable law.

38. RELATIONSHIP TO OTHER AGREEMENTS

These website Terms are intended to govern general use of the website and associated online resources.

They do not necessarily replace an engagement agreement, representation agreement, grant requirement, program agreement, consent form, employment agreement, volunteer agreement, donor agreement, contract, or other specific agreement between Alianza and another person or organization.

Where a separate written agreement governs a particular relationship or service, the provisions of that agreement may control with respect to the subject matter it specifically addresses.
